New Jersey contractor rules, in plain language

New Jersey regulates siding contractors as home improvement contractors. They register with the Division of Consumer Affairs, and state law sets out what their contracts must say. A summary, with links to the Division and the statute.

Registration and how to check it

The Division of Consumer Affairs describes home improvement contractor businesses as those that repair, renovate, install, replace or improve residential properties, and names roofing and siding among the work they do (Division page).

To check a business, open the Division’s license verification system and use Business Search, since home improvement registrations are issued in the business's name. You can also call the Division on 1-800-242-5846 (from within New Jersey) to ask whether a contractor is registered and whether there have been complaints or actions against it (Division release).

Vineland's construction page reminds homeowners to look for the registration number on documents, advertisements and vehicles (city page).

What a home improvement contract must contain

Every home improvement contract above a small minimum price, and every change to it, must be in writing and signed by all parties (statute text).

Who
The legal name, business address and registration number of the contractor business.
Insurance
A copy of the certificate of commercial general liability insurance and the phone number of the insurer.
Price
The total price or other consideration, including finance charges.
Clear terms
All terms and conditions set out legibly and in understandable language.
Cancellation notice
A conspicuous notice in at least 10-point bold type explaining your right to cancel.

Your three business days

You may cancel a home improvement contract for any reason before midnight of the third business day after you receive a copy of it. Cancel in writing, sent by registered or certified mail with return receipt requested, or delivered by hand to the address in the contract. Money paid must be refunded within 30 days of the contractor receiving the notice, and a credit or loan agreement arranged through the contractor is cancelled too (N.J.S.A. 56:8-151(b)).

The Division has also advised getting start and completion dates and a description of the work in the contract, getting warranties in writing, naming the materials' brands or grades, and making sure the contractor gets any permits the job needs (Division release).

Insurance claims

This site doesn't help with insurance claims and doesn't refer claim work. If your siding was damaged in a storm, contact your insurer directly.
